Real Property Review

On March 11, 2009, the City Council passed Resolution No. 2009-02 establishing an annual process for surplusing City property. In accordance with said resolution, a comprehensive inventory of real property owned by the City was created, and a Real Property Committee was established to review the property inventory and ascertain which properties are no longer used by the City.
 
At the July 8, 2009 regular City Council meeting, City Manager Mark Dombroski presented the findings of the Real Property Review Committee and two memoranda with recommendations to surplus property (links below).

At that same meeting, the City Council created an ad hoc committee comprised of representatives from each of the Council committees, and directed the committee to review the real property inventory, evaluate the recommendations of the Real Property Review Committee to surplus property and report their recommendations to the City Council for further action before August 26, 2009. Councilmembers assigned to the ad hoc committee are Kim Brackett, Barry Peters, Kjell Stoknes and Debbie Vancil.

At the August 12, 2009 City Council meeting, the Council agreed to conduct two special City Council meetings on August 19 and September 2, 2009 to discuss, among other topics, the surplus property issue.

On August 13, 2009, the ad hoc committee met with City Manager Mark Dombroski, City Attorney Paul McMurray and Interim Public Works Director Lance Newkirk to review the real property inventory and evaluate the recommendations of the Real Property Review Committee. The ad hoc committee agreed to focus the initial meeting on the 8 properties recommended for surplus and sale, and discuss the 22 recreational properties at a later date. A majority of the ad hoc committee agreed that the 8 properties should be surplused and sold and that the City Council should hold public hearings regarding whether to surplus and sell these properties. The committee also agreed that the subject of the first public hearing should be whether to surplus and sell four properties commonly known as:
  1. Miller Road Shed/Old County Road Maintenance Site (Parcel No. 202502-1-049-2002);
  2. Parcel adjacent to Sakai/Virginia Villa Parcels (Parcel No. 232502-3-047-2007);
  3. Portion of Vincent Road Landfill (Parcel No. 332502-2-001-2001); and
  4. Weaver Avenue Well Site (Parcel No. 272502-4-035-2005).
The ad hoc committee recommended that separate public hearings should be held later to determine whether to surplus and sell the four other properties commonly known as:
  1. Manitou Beach/Kane Parcel (Parcel No. 142502-3-109-2003);
  2. Myer’s Pit (Parcel No. 272502-2-016-2002);
  3. Old Decant Facility (Parcel No. 272502-2-050-2009); and 
  4. Suzuki Property (Parcel No. 222502-4-006-2005).

The ad hoc committee agreed to present their recommendations to the full City Council at a special meeting to be held on August 19, 2009.

On August 19, 2009, City Council unanimously recommended that the City Council hold a public hearing for the four properties described above and a separate public hearing for the Myer’s Pit and Old Decant Facility to allow for an open public dialogue regarding whether to surplus and sell said properties, with the first of these hearings to occur on September 2, 2009.

On September 2, 2009, a public hearing for the first four properties was held. Following the public hearing, the City Council approved Resolution No. 2009-20 surplusing the Miller Road Shed/Old County Road Maintenance Site, Resolution No. 2009-22 surplusing a portion of the Vincent Road Landfill, Resolution No. 2009-23 surplusing the Weaver Avenue Well Site, and Resolution No. 2009-24 surplusing Myer’s Pit and the Old Decant Facility. Resolution No. 2009-21 relating to the parcel adjacent to Sakai/Virginia Villa parcels was returned to committee for further consideration and a possible conservation easement.
 
The City Manager or his designee will negotiate real estate purchase and sale agreements, together with other legal documents necessary to sell the surplused properties. Additional conditions as described in the resolutions will need to be met prior to each sale. A limited/summary appraisal of each property will need to be done by a certified appraiser to establish each sale price, and each sale will be contingent on the completion of an environmental review in accordance with the State Environmental Policy Act and the expiration of the SEPA appeal period. Proceeds from each sale will be returned to the fund used for acquisition of the property.
